Ms. Park was driving through a four-way stop sign intersection in San Francisco when she was broadsided by another car. This was a medically complicated case because at the time of the accident, Ms. Park had a congenital condition known as Klippel-Feil Syndrome, which meant that two her cervical discs were fused at birth. Prior to the accident, this syndrome was completely asymptomatic. But after the accident, Ms. Park developed a severe case of cervical myelopathy, which occurs when the spinal cord in the neck is compressed, which led to a surgical recommendation.
Despite Defendant hiring a medical expert who testified that Ms. Park's cervical myelopathy was due 100% to her prior medical condition and not in any way caused by the accident, we a $500,000 pre-trial settlement. Mrs. Park used $100,000 of the settlement to purchase an annuity that paid her $1,675 per month for five years.
